1. Introduction  
1.1 These Terms and Conditions ("Terms") govern your use of sheikhnajam.com ("Website") and the provision of information about legal services by Sheikh Najam ("we", "us", "our"). By accessing or using the Website you accept these Terms. If you instruct us, separate engagement terms will apply.

2. About Us

3. Scope of Website Information  
3.1 The Website provides general information about dispute resolution and international law services (including negotiation, mediation, arbitration and litigation). Content is for guidance only and does not constitute legal advice or form a solicitor‑client relationship.  
3.2 You should not act or refrain from acting on the basis of information on the Website without seeking specific professional advice.

4. No Client Relationship / Initial Enquiries  
4.1 Viewing the Website, submitting an enquiry or receiving initial information does not create a lawyer‑client relationship. A formal engagement only arises if and when we issue and you accept a written engagement letter that sets out scope, fees and terms.  
4.2 We may decline to accept instructions at our discretion.

5. Legal Advice and Engagement Terms  
5.1 If you instruct us, we will provide a written engagement letter or email setting out the scope of work, fees, billing arrangements, estimates, terms of engagement and complaints procedure. Our engagement terms will take precedence over these Website Terms in respect of the instructed matter.  
5.2 Fees: we use a variety of fee arrangements including hourly rates, fixed fees, capped fees and staged billing. All fee estimates are indicative and subject to change if the scope or circumstances alter. We will notify you of material changes and, where practicable, obtain your agreement before additional work proceeds.  
5.3 Expenses: you are responsible for disbursements (court fees, counsel, expert fees, travel costs, filing and registry charges) incurred on your behalf.

6. Confidentiality and Data Protection  
6.1 We treat client information as confidential in accordance with professional obligations. Please do not send sensitive or privileged material via the Website until a secure method of communication has been agreed.  
6.2 Personal data submitted via the Website will be processed in accordance with our Privacy Policy. By using the Website you consent to such processing.

7. Conflicts and Independence  
7.1 We will carry out a conflicts check on receipt of client details. If a conflict of interest is identified we may need to decline or withdraw from acting. We will explain any conflict and the proposed next steps.

8. Intellectual Property  
8.1 All content on the Website (text, images, logos, downloads) is protected by copyright and other intellectual property rights owned or licensed by us. You may view and print pages for personal, non‑commercial use but must not reproduce, modify, transmit or use Website content without our prior written consent.

11.1 Communications by email or via the Website are not confidential unless otherwise agreed. We do not accept liability for interception or corruption of electronic communications. For highly sensitive information we will agree secure transmission methods.  
11.2 You must not transmit malicious code or otherwise interfere with the Website.

13. Fees and Payment for Website Products (if applicable)  
13.1 Where the Website offers paid downloads, documents or booking services, separate payment and delivery terms apply. Payment must be made in the currency specified and cleared before delivery. Refunds will be provided only in accordance with the relevant product terms.

14. Termination  
14.1 Either party may terminate an engagement in accordance with the engagement letter. On termination you must pay for work performed and expenses incurred up to the termination date. We will retain and return documents as required by regulation and professional practice.

15. Governing Law and Jurisdiction  
15.1 These Terms and any dispute arising from, or related to, the Website are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction to settle disputes.

16. Changes to Terms  
16.1 We may update these Terms from time to time. The “Last updated” date at the top of the page will show the current version. Continued use of the Website after changes are posted constitutes acceptance of the revised Terms.
